When someone has been convicted of a crime, his or her conviction and sentencing may still be reversed or vacated if there were mistakes in the trial or guilty plea, if there is newly discovered evidence that would exonerate the defendant, or if there was ineffective assistance of counsel.
- We may be contacted by the defendant, the defendant's family or friend, or through an attorney referral.
- We have experience with appeals in death penalty cases and with cases involving life sentences or sentences of 40 or 50 years or more.
- We have experience redressing the immigration consequences of criminal convictions for our clients, helping them avoid deportation
- Appeals in state cases can eventually reach the federal courts. We have Florida and federal appeals experience.
- An appeal takes an extraordinary amount of research including reviewing long trial transcripts, organizing the material, researching the law, and preparing written arguments.
- The appellate lawyer must be able to present a persuasive oral argument in only 15-20 minutes before the court.
- Because in the criminal appeals process there is a presumption that every conviction is valid, you need an attorney willing and able to do the massive work necessary.
- Were your constitutional rights violated? Did you have ineffective counsel? Has new evidence come to light • DNA evidence, for example? Talk to us about a criminal appeal.
At Robbins, Tunkey, Ross, Amsel, Raben & Waxman, our entire legal practice is focused on protecting the rights and aggressively defending people charged with state and federal crimes. We are one of the nation's largest and most sought-after criminal defense law firms.
