| FEDERAL SENTENCING: A GOOD DEPARTURE IS HARD TO BEAT
This presentation, given by Alan S. Ross, discusses the Federal Sentencing Guidelines, which were written to obtain uniformity in sentencing on a national level. Mr. Ross explores the Guidelines’ failure to dispel the disparity among different judges with regard to their views of downward departures in similar cases. In fact, as Mr. Ross points out, in some jurisdictions, downward departures from the sentencing guidelines are rarely granted, and in other jurisdictions they are very common. |

| Blakely v. Washington- “The Aftermath” - This presentation, given by Mr. Alan S. Ross to the National Criminal Law CLE Conference, discusses the affect that Blakely v. Washington had on the Federal Sentencing Guidelines. Some courts have interpreted Blakely to render the guidelines unconstitutional, while others have found that Blakely does not apply to the Federal Guidelines as it does to the State Guidelines. This issue was ultimately resolved with the U.S. Supreme Court decision in United States v. Booker, which finalized the debate and rendered the Federal Sentencing Guidelines unconstitutional, thus requiring the courts to treat them merely as unconstitutional. |
